CERTIFICATE OF INDEPENDENT LEGAL ADVICE

Financial institutions require borrowers and guarantors to seek independent legal advice. Prior to signing your loan agreement, these institutions are required to obtain a Solicitor’s Certificate of Independent Legal Advice.

This certificate attests that a person has received legal advice on the proposed contract from a lawyer who has no association with the other contracting party.

Shire Legal can review loan documents and guarantees, advise you on your rights and obligations under the loan and provide you with a Certificate of Independent Legal Advice.

Shire Legal has experiencing in advising:

  • parents guaranteeing their adult child’s home loan;
  • company directors guaranteeing loans to the company; and
  • beneficiaries of self-managed superannuation funds (SMSFs), purchasing property via a bare trust.

Depending on existing workload, the documentation can be reviewed and advice provided within 24-48 hours of documentation being emailed to Shire Legal and instructions being confirmed.
